There were several reasons not to talk with the cops and only one good reason to do so. The reason to do it was the rare occasion when an honest explanation of your conduct is believed and exonerates you from suspicion. That was beyond rare. If you were already in the interrogation room, there was a reason, and the cops were unlikely to give up on that reason just because they might be wrong.

The other catch to that approach was that it really did need to be the truth. Lying to a cop about anything that might be material to a pending investigation was a crime in and of itself. If a cop walks up to you out of the blue and asks you your name, you can say, “Mickey Mouse,” because it’s not material to anything important. But if you’re sitting in Interrogation Room B of the Seattle Police Department’s main precinct, anything you say is material to something important. If you were going to lie, you needed to be sure you were going to get away with it.

Which led Raine to his conundrum. He had a reasonable explanation as to why Detective Kahale found him inside his murder client’s murder victim’s business after midnight. It wasn’t a true explanation, but it was reasonable. It could have been true. And it was supported by the physical evidence of the laceration on the back of his head.

He was out late at night, thinking about the case or whatever, when he decided to drive by the business offices of his client’s alleged victim. He didn’t know what he might find so late at night, but it was a mostly free country so he figured he’d go and see what he might see. But when he got there, he observed a masked figure sneaking into the building. Should he have stayed outside and called the police? Of course. But hindsight is twenty-twenty and he made the different decision to go in after the man and stop whatever nefarious misdeeds he had planned. Add something about being a man and being overconfident in his own strength and power to win any fight. Once inside, however, the true burglar surprised him and struck him in the back of the head with his giant flashlight, then escaped into the night. Someone else must have called the police and they arrived just as he was leaving the building to call the police himself.

It was a good story. The problem Raine had was that he had no idea how much information Kahale had that could rebut all or part of it. It was a lie, after all. Maybe the 911 caller reported seeing a man and a woman entering the building. Maybe the cops had been there long enough to see all three of them enter. Were there cameras somewhere? Had they also arrested the other man and not told him? Raine could have been in a prisoner’s dilemma without even knowing it.

No, the wiser decision was
